The Past That Judges Us - Justice and Politics to Correct Our Course
The Past That Judges Us - Justice and Politics to Correct Our Course
Is Brazil a Country for the Wealthy? When wealth opens institutional doors while the Body-Territory must sacrifice its lifetime to exercise rights already recognized by law.
Who Inherited Brazil?
Imagine two children being born in the same country.
One inherits wealth, property, lawyers, and relationships that facilitate access to institutions.
The other faces difficulties obtaining housing, food, education, and legal assistance.
Both possess the rights recognized by Brazil's 1988 Constitution.
But will they experience the same possibilities?
At BrainLatam, we investigate three temporal bodies: past, present, and future.
The first encompasses memories, rights, decisions, and consequences that remain active in our lives.
Is Brazil a country for the wealthy?
I want to investigate this question with you, recognizing that inequality may continue to be produced by decisions made before we were even born.
Justice Must Also Examine Its Own Pathways
Imagine facing a legal proceeding that requires documents, specialists, and years of monitoring.
Now imagine possessing the resources to hire major law firms and maintain ongoing access to different institutional authorities.
The right to legal defense belongs to everyone.
However, wealth can dramatically expand the material conditions under which that right is exercised.
Investigations involving Banco Master have made this disparity particularly visible.
The case involves financial transactions, business relationships, and contacts with public authorities.
We must distinguish documented facts, allegations under investigation, and established responsibility.
Justice protects rights when it applies guarantees equally and allows transparent scrutiny of relationships that may compromise its independence.
When Powerful Interests Reach the Supreme Court
In 2026, messages and documents related to Daniel Vorcaro revealed direct or indirect contacts with members of Brazil's Federal Supreme Court.
Reports described relationships involving Alexandre de Moraes, Dias Toffoli, Luiz Fux, André Mendonça, and Kassio Nunes Marques.
The episodes included travel, meetings, legal contracts, and events.
The law firm associated with Viviane Barci de Moraes, Alexandre de Moraes's wife, maintained a high-value contract with Banco Master.
Dias Toffoli stepped aside from overseeing the case amid controversy surrounding his relationships with individuals mentioned in the investigations.
These records differ in nature and legal significance.
Knowing a public official, hiring a relative, or attending an event does not, by itself, establish corruption.
Nevertheless, such relationships may require transparency and examination of potential conflicts of interest.
Mendonça, Fux, and Different Responsibilities
André Mendonça confirmed meeting Vorcaro in March 2025 to hear a request involving court-ordered government debts, known in Brazil as precatórios.
The justice stated that his subsequent decisions went against Banco Master's interests.
Messages also mentioned arrangements connected to an event honoring Luiz Fux in New York.
Fux later participated in judicial decisions related to the investigations.
These events do not justify concluding that the justices committed wrongdoing.
They do, however, invite us to investigate how private meetings, events, and relationships can be recorded, examined, and subjected to institutional safeguards.
How can society evaluate judicial independence when it does not know all the pathways through which powerful interests reach the courts?
R$427 Million and the “KN Group”
Reports on documents obtained by Brazil's Federal Police described a legal services agreement providing for success fees estimated at R$427 million.
The agreement involved proceedings concerning approximately R$8.5 billion in court-ordered government debts.
Messages used the expression “Turma do KN,” or “KN Group,” which investigators and reporters associated with individuals close to Kassio Nunes Marques.
The justice denies wrongdoing and states that he did not act to benefit Vorcaro personally.
The R$427 million represents a contractual fee contingent on success, not a proven payment to the justice.
Now imagine someone unaware of their entitlement to a social security benefit.
They may never find the legal resources necessary to defend it.
The disparity in resources available to pursue rights deserves investigation regardless of individual responsibility in any particular case.
Flávio Bolsonaro, the Private Jet, and the Offshore Company
In October 2026, documents reported by the Brazilian press indicated that Flávio Bolsonaro appeared as a “master user” in records related to an Alcazar Holdings bank account.
The company was connected to the ownership structure of an aircraft used by the senator and also linked to businesses in which Vorcaro had participated.
Flávio Bolsonaro and lawyer Willer Tomaz deny any partnership or financial wrongdoing.
The documents reported so far do not establish a direct business partnership between the senator and Vorcaro.
Nevertheless, the records raise questions about their origin, operational implications, and any potential responsibilities.
The State must be capable of tracing the movement of money without turning suspicions into premature verdicts.
A Film About the Past and Money Sent Abroad
Another investigation concerns Dark Horse, a film about Jair Bolsonaro.
Brazil's Federal Police requested international cooperation to trace funds transferred to the United States through business structures associated with Vorcaro.
The inquiries include suspicions involving unlawful international transfers and possible financial irregularities.
Flávio Bolsonaro acknowledged participating in efforts to raise financing for the project, but maintains that the funds were private and denies wrongdoing.
There is no judicial finding establishing that embezzled public money financed the film.
The question that concerns us extends beyond filmmaking.
Who has the resources to finance the narratives through which the past will be remembered?
Our perception already represents a selection of reality.
On screens, we encounter a selection of that selection.
When Wealth Shapes the Narratives We Encounter
Grupo Globo dismissed executive Frederic Kachar following the disclosure of conversations with Vorcaro.
The messages included requests concerning publications, discussions about journalistic coverage, and commercial negotiations.
The company described the relationship between its executive and an advertiser as inappropriate.
Other reports raised questions about attempts to influence editorial decisions across media organizations.
We must examine the specific responsibilities of each organization.
But the structural problem remains.
If wealth can finance narratives, influence their circulation, and facilitate access to public institutions, democracy needs stronger mechanisms of transparency.
Who is choosing the fragments of reality that reach us?
Public Lands and the Constitution Left Unfulfilled
Now imagine families searching for land where they can produce food.
In São Paulo, public-land regularization policies have allowed sales with substantial discounts.
A report published by Agência Pública in November 2025 identified conditions under which acquisition prices could amount to approximately 10% of reference values.
The original legislation was passed in 2022 and subsequently extended during Governor Tarcísio de Freitas's administration.
The São Paulo government defends regularization as a means of providing legal certainty and says it benefits small producers.
The federal government presented proposals to allocate land for agrarian reform.
When public property can serve different purposes, who participates in deciding its destination, and who receives the benefits?
The Past Continues Producing Inequality
Brazil's 1988 Constitution establishes the social function of rural property.
Articles 184, 186, and 188 address agrarian reform, land-use requirements, and the allocation of public lands.
In 2025, the Pastoral Land Commission recorded 1,593 incidents of rural conflict.
The number of killings recorded in these conflicts increased from 13 in 2024 to 26 in 2025.
Imagine how many human stories those figures contain.
Territory means food, work, culture, water, and belonging.
The past continues participating in our existence as long as its consequences determine who can sustain and produce life in a particular place.
The Fourth Power: A State That Does Not Lose Its Memory
Imagine a family searching for documents concerning a public decision made forty years ago.
The officials have changed. Administrations have ended. Archives are scattered.
At BrainLatam, we have developed the proposal for a Fourth Power — Time, Value, Finance, and Memory.
Its scope includes preserving an auditable history of public decisions.
Who proposed them? Who decided? Which resources were used? Who benefited? Which rights remained without remedy?
Institutional memory must outlast individual governments.
The State should not force each generation to spend its own lifetime reconstructing what its institutions already knew.
Personalissima AI and the Man of Maize
Imagine having a Personalissima AI capable of tracking your rights, interpreting regulations, identifying deadlines, and preparing requests you have authorized.
An institutional decision affects your life.
Your personal interface identifies the event, explains its consequences, and presents possible avenues for appeal.
You remain the author of your decisions.
And you can preserve your attention for work, learning, caring for your family, and experiencing your Biome.
Within the BrainLatam framework, the Body-Territory constitutes the smallest and indivisible unit of the State.
Citizen Drex and Biome Income are part of our proposals for economic participation and ecological sustainability.
The Man of Maize recognizes his existence through food, culture, and relationships.
The State must recognize itself in each Body-Territory as its indivisible constituent unit, understanding that protecting each person's lifetime means preserving the very existence of the State.
Justice as a Way to Correct Our Course
Ailton Krenak invites us to recognize futures emerging through ancestral relationships.
Silvia Rivera Cusicanqui investigates how different temporalities continue to coexist within our territories.
At BrainLatam, Jiwasa represents shared agency.
We can acknowledge historical harm, investigate responsibility, and correct institutions while preserving everyone's legal guarantees.
The past offers knowledge.
Justice can recognize consequences.
Politics can transform institutions.
We are heirs to the past, participants in the present, and jointly responsible for the futures we make possible for the next Body-Territories.
Brazil will cease to be perceived as a country for the wealthy when understanding and exercising rights no longer depend primarily on wealth, personal connections, or the lifetime each person can afford to sacrifice.
And now the question belongs to you:
If the State possesses memory, knowledge, and technology, why must each Body-Territory still spend its own lifetime searching for rights that already belong to it?
